RETAINING KNIGHTS LPC

Upon completion of our initial consultation and we have a better understanding of your needs and details related to your charge, we will provide you with your options and estimated costs.  Upon agreement and  mutual understanding, the following steps are recommended to ensure we can immediately begin representing you:

  • Provide Knights LPC with all documentation you have related to your charges
  • Provide a signed “Designation of Counsel” that will inform the court Knights LPC wll be the Lawyers of record for your matter
  • Provide Knights LPC an initial deposit towards your retainer

Knights LPC will represent you in the preliminary proceedings as such, you will not have to attend Court personally until the actual court date of your trial. As your legal representation, will keep you fully informed in advanced as to when, where and if you will have to attend.

BLOCK FEES AND PAYMENT OPTIONS

Its our mandate to ensure our clients understand the general costs involved prior to engaging Knights LPC. We do not provide a final fee of services regarding your matter until we receive and examine all disclosure from the Crown and Police and are provided instructions as to how our client wants to proceed.  Our fees are typically based on block rates which are fees that will not change, rather than an hourly rate that can be difficult to budget for the client.

We are aware that these types of expenses are not planned and often place a strain on finances. We know our clients have variable financial means at their disposal and as a solution,  it is our mandate to offer transparent and flexible payment options that assist this process.

WE HELP VICTIMS OF CRIME

The Criminal Injuries Compensation Board does not expect you to have a legal representative at a hearing, but you can have one if you want. A legal representative can be a lawyer or paralegal. Knights LPC will communicate with the CIBC as your designated representative to ensure your application or application appeal process is handled properly.

Are you a Victim of a Crime?

Knights LPC assists victims of crimes access necessary information, services and resources who are in need.  If you are a victim of a crime, you and your family members may be eligible for compensation for pain and suffering, loss of income, treatment expenses, funeral expenses and other costs that may have resulted of crimes of violence that occurred in Ontario. Knights LPC works with victims of crimes to bring applications and assist with hearings at the Criminal Injuries Compensation Board.

Our services help victims apply for financial compensation and services through government programs such as the, Criminal Injuries Compensation Board,  Financial Assistance for Families of Homicide Victims or the Victim Quick Response Program

Pardons and Waivers

Formerly known as a pardon, a record suspension gives an individual a second chance to be free from past mistakes. Regardless of your status of residency or citizenship, if you’ve been charged or convicted of a crime in a Canadian court of law you can apply to have your criminal record kept separate and apart from other criminal records.  This means, if a criminal background record check is required of you, it will come up clear.

Even small offences can have a big impact and follow you around for the rest of your life. Applying for a pardon or a waiver on your own can be a difficult process; applications submitted incorrectly can be returned or denied and the associated fees may be non-refundable.

A Canadian Pardon can seal a criminal record and a US Waiver will allow you to legally cross the United States-Canadian Border if you have been deemed ineligible by the government. These documents help you to move on with your life and take back control.

Common Questions
What are the types of criminal convictions?
There are three types of Criminal offences:

• Indictable offences
• Summary conviction offences
• Hybrid offences

For some offences, the information will charge you with an indictable offence but you will be convicted of a summary conviction offence. It does not matter what kind of conviction you received. If the information says that the Crown chose to proceed by way of indictment, then you can appeal to the Court of Appeal. If not, you must appeal to the Superior Court of Justice.

If you are convicted of both an indictable offence and a summary conviction offence, you can bring an appeal on both convictions to the Court of Appeal.

What is an Indictable Offence?
Indictable offences are the most serious offences.

Common examples are sexual offences against young people, criminal negligence causing bodily harm or death, theft over $5000, robbery, and murder.

What is a Summary Conviction?
Summary conviction offences are less serious than indictable offences. Common examples are causing a public disturbance and simple possession of drugs.
What is a Hybrid Offence?
Hybrid offences can either be indictable or summary conviction offences.

On the information, the Crown will decide how serious the offence is and will choose to prosecute you for an indictable offence if it is serious or for a summary conviction offence if it is less serious.

Common examples are impaired driving, theft under $5000, common assault, and sexual assault.
